1. General

1. The use of this site is governed by the terms and conditions. These terms and conditions should be understood by people purchasing memberships with NobleDentist. This is necessary as you are required to accept these terms before proceeding to purchase a membership.
2. NobleDentist reserves the right to make changes to this site and these terms and conditions at any time.

2. Membership Policy

1. Only applications completed correctly and paid in full will be granted membership.
2. We reserve the right to verify the details submitted to obtain a membership. Applications may be declined if details submitted are not adequate.
3. Family memberships include the applicant and his or her spouse or de-facto and dependent children at a single address. Photo identification may be requested when visiting a participating dentist to verify the identity of a person possessing a NobleDentist membership card.
4. Memberships may be cancelled before the duration stipulated if the membership is being utilised by unauthorised users. A refund will not be given.
5. This online system is available to both individuals and business users.
6. You must be at least 18 years old to submit an application for membership with NobleDentist.
7. You must be the legal owner of the credit card being used to make payment for a membership.
8. Your receipt of an electronic or other form of confirmation does not signify our acceptance of your application. NobleDentist reserves the right at any time after the receipt of the application to accept or decline for any reason. NobleDentist may require additional verification or information before granting a membership.
9. NobleDentist has a 90-day money back guarantee given in the event the member is not satisfied with their membership. This means that members can receive a refund if sought within 90 days of their joining date. Members will need to supply reason/s for seeking a refund, the participating dentist attended, and to return membership card/s to NobleDentist before receiving the refund. In the event that the member joins again, the member will not be entitled to a refund. NobleDentist may refuse to accept a future membership application from a member who has sought a refund in the past.
10. NobleDentist does not suspend memberships. Membership commences from the date of payment and does not cease until the expiry date is reached.
11. The member agrees and understands that they are entering into a binding contract by electronically accepting the Terms & Conditions.

3. Member Responsibilities

1. You are responsible for ensuring that all application details provided to NobleDentist is correct.
2. Necessary updates of these details must be made promptly using your Member Log-in located at www.nobledentist.com.au
3. You must ensure to inform the participating dental practice that you are a member of NobleDentist when making an appointment and present your membership card to the reception on arrival at the practice.
4. You must ensure that you will not allow any unauthorised use of membership by third parties.
5. You must ensure to report the loss or theft of your membership card to NobleDentist.
6. Members must ensure that membership cards are kept in good condition. Participating dentists and staff must be able to ascertain necessary information from the membership card. Replacement of membership cards will incur a service charge to the member.

4. Fee Schedule

1. Any dental services not included in the NobleDentist Fee Schedule are reduced by 15% unless otherwise stated.
2. A reduction of fees does not apply for services performed by a specialist unless the specialist is a participating dentist in the NobleDentist community.
3. The NobleDentist Fee Schedule is subject to change without notice.

5. Exclusion of Warranties

1. NobleDentist can not guarantee continuous, uninterrupted access to our site or links within NobleDentist. Operation of this site and our services may be interfered with by numerous factors including ones outside our control. Best efforts will be made to ensure that interruptions are minimised. Rest assured NobleDentist will work diligently to rectify technical problems.
2. NobleDentist provides this service without any warranty or condition, express or implied. NobleDentist expressly excludes all warranties of any kind including any implied warranties as to fitness of purpose or merchantability of this service or that using this service will not result in infringement of third party rights. NobleDentist makes no warranty that the services provided by us, will be timely, secure or error free.

6. Limitation of Liability

1. NobleDentist will not be liable for any lost profit or any direct, indirect, incidental, special or consequential loss or damage related to your use of the NobleDentist site and other services.
2. NobleDentist makes no guarantees or representations regarding products or services sold on the NobleDentist site unless expressly stated.
3. NobleDentist is not liable for any typographical errors which appear in on the NobleDentist site regardless of whether the relevant error is our responsibility.
4. NobleDentist expressly disclaims all warranties express or implied of any kind with respect to products sold on this site including but not limited to merchantability and fitness for a particular purpose except as expressly stated.
5. You agree that the sole and exclusive maximum liability to NobleDentist arising from any product sold on the NobleDentist site shall be the price of the product ordered.

7. Indemnity

1. You agree to indemnify us and our subsidiaries, related companies, officers, directors, employees and agents harmless from all liability.
2. This includes liability in connection with infringement of a third party’s intellectual property right or moral right and negligence.
3. This also includes any claim in connection with these Terms, NobleDentist site, or use of the NobleDentist site and our services.

8. Payment Terms

1. Memberships will last for 24 months from the date of payment. NobleDentist may offer memberships that last for longer periods for promotional reasons.
2. Memberships will be based on individual, couple, and family coverage.
3. Credits cards may be used to pay for memberships. Visa and MasterCard will be used via the PayPal system. NobleDentist does not store or record credit card numbers.
4. Secure transmission is made directly through PayPal and we receive and display a response to your transaction which is also sent to you via your registered e-mail address. NobleDentist does not issue membership until a successful payment has been confirmed.
5. NobleDentist will have the right to refuse or cancel any applications placed for memberships at the incorrect price in the event a membership is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information.
6. NobleDentist shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. NobleDentist shall immediately issue a credit to your credit card account in the amount of the charge if your credit card has already been charged for the purchase and your order is cancelled.
7. NobleDentist may also accept other methods of payment at their discretion. These include cheques and money orders.

9. Membership Renewal

1. NobleDentist will give notice via email or telephone that your membership will be expiring prior to the expiration date identified in your membership confirmation.
2. It is the responsibility of members to supply NobleDentist with current payment information to process the membership renewal.
3. In all events it is the responsibility of the member to ensure that NobleDentist has received payment for membership prior to the expiration date identified on the membership card. NobleDentist is not responsible and assumes no liability to any member for failure to provide NobleDentist with current payment information for membership renewal.

10. Security Matters

1. NobleDentist need to collect certain personal information from people in order to grant membership. We may contact you to ascertain particulars that would improve the services provided to members. Membership will not be granted without this information.
2. NobleDentist will not disclose your information to third parties. Information may be used by us in order to improve services provided to members and visitors to the NobleDentist site. Reference can be made to the Privacy Policy for a detailed explanation of the use of personal information.
3. Membership cards are allocated by NobleDentist to members. The membership card will display membership numbers. Community providers responsible for administering treatment will need to sight the membership card. Picture identification may also be requested from the provider to confirm the identity of the member. It is important that you keep your membership card safely. Otherwise your membership could be used by an unauthorised third party. It is important to know that any misuse of membership may result in termination of membership.

Unauthorised reproduction, adaptation, modification, distribution, transmission, republication, display or performance of this software is strictly prohibited and could result in criminal or civil penalties.

12. Trademarks

1. NobleDentist is a registered Trademark.
2. This trademark may not be used without the express permission of NobleDentist Pty Ltd.

13. No Offer Where Illegality Arises

1. Nothing on the NobleDentist site constitutes an offer to provide goods or services in any jurisdiction if to do so would contravene the laws of that jurisdiction.

14. Other Websites

1. NobleDentist Pty Ltd makes no representations or warranties about any other website that you may access through the NobleDentist site.
2. Please be aware when accessing a site other than NobleDentist that it is independent from the NobleDentist site and NobleDentist Pty Ltd has no control over the content of that website.
3. NobleDentist Pty Ltd does not endorse or accept any responsibility for the content or use of any third party website linked from the NobleDentist site.

15. Access to Site Outside Australia

1. We do not warrant that content on the NobleDentist site complies with the laws of any country outside of Australia.
2. If you access the NobleDentist site from outside Australia you do so at your own risk and you accept responsibility for ensuring or confirming compliance with all laws that apply to you as a result of that access. This includes subsequent dealings via the NobleDentist site or as a result of accessing this site.
